Depending on the scope of the review, the attorney may also examine zoning regulations and check publicly available records for potential environmental contamination.

It is equally important to confirm that the seller is legally entitled to dispose of the property and that all required permits are in place. For new construction or planned renovations, building permits are essential. Missing or unauthorized permits can result in significant costs if subsequent legalization is required.

In Austria, real estate transactions are typically handled by attorneys or notaries acting as escrow agents. The escrow agent drafts the purchase agreement based on the buyer’s offer and oversees the proper execution of the transaction. This includes clearing encumbrances from the title, calculating and remitting taxes, and arranging registration in the land register.

Funds are usually held in a dedicated escrow account. As a rule, the purchase price is released to the seller only once the buyer is officially registered as the new owner in the land register (with certain exceptions, such as developer contracts).

Independence as a Decisive Factor

For many buyers, independence is a key consideration when choosing an advisor. Sellers and their agents naturally focus on maximizing the sale, while independent property experts have no financial interest in closing the deal. They can provide an objective assessment of whether the asking price is reasonable—or whether walking away may be the wiser option.

The same principle applies to the purchase agreement itself. Although the escrow agent is responsible for ensuring balance and fairness, he or she is usually selected by the seller or broker. Buyers who want maximum protection may benefit from having the agreement additionally reviewed by an independent attorney who is not also serving as the escrow agent.
